Terms and Conditions
Bake A Cake Effective date: 10/9/2026
These terms apply to purchases and class bookings made through bakeacaketx.com and in our Pharr, TX store. By placing an order or booking a class you agree to them. If you don't agree, please don't use the site.
1. Orders and acceptance
An order is an offer to buy. We accept it when we send a shipping confirmation or, for pickup orders, a ready-for-pickup notice. We may decline or cancel an order for reasons including pricing or listing errors, suspected fraud, or stock problems; if we do, we'll refund anything you've paid. Prices are in U.S. dollars and can change without notice; the price shown at checkout is the price you pay. Sales tax is added where required.
2. Payment
We accept the payment methods shown at checkout. Card payments are processed by Stripe. By paying you confirm you are authorized to use the payment method. Orders are not confirmed until payment clears.
3. Shipping
We ship within the United States. Shipping costs and estimated times are shown at checkout; estimates are not guarantees, and delays by the carrier are outside our control. Risk of loss passes to you when the carrier accepts the package. Please check the address you enter; we can't redirect packages once shipped and aren't responsible for orders sent to an incorrect address you provided. If a package arrives damaged, contact us within [5] days with photos so we can file a claim and make it right.
Heat-sensitive items. Chocolate, candy melts, some fondants, and similar products can soften or melt in transit, especially in summer. We ship these at your risk unless you choose an expedited option we recommend; melted-in-transit products are not eligible for refund.
Local pickup. Pickup orders are held for [14] days from the ready notice. Orders not collected may be cancelled and refunded less any custom-item costs.
4. Returns and refunds
Unopened supplies and tools may be returned within 30 days of delivery for a refund or exchange, provided they are unused, in original packaging, and in resalable condition. Return shipping is at your cost unless the item arrived damaged or we sent the wrong item. Refunds go to the original payment method within [10] business days of our receiving the return.
Not returnable: food, ingredients, flavors, colors, sprinkles, and any edible product (for safety reasons); opened or used items; clearance and final-sale items; custom and personalized items (see section 5).
5. Custom orders and edible images
Edible images, custom toppers, and personalized items are made to your order and can't be returned or refunded unless we made an error. You're responsible for the artwork you upload: by uploading it you confirm you own it or have permission to use it (including any logos, characters, or photos) and you authorize us to print it for your order. We may refuse artwork we consider unlawful, infringing, or offensive. Please proof your text and spelling carefully; we print what you send.
6. Classes and events
Booking. Class seats are confirmed when paid. Class dates, times, instructors, and content may change; we'll notify you by email if a class you've booked changes or is cancelled, and you'll get a full refund or a transfer for any class we cancel.
Cancellations by you. Cancel at least [48 hours] before the class for a refund or credit toward another class. Cancellations inside that window, and no-shows, are not refundable, but you're welcome to send someone in your place; let us know their name.
At the class. Classes include listed materials. Ages and requirements are shown on each class listing; attendees under the listed minimum age must be accompanied by an adult. Please tell us about food allergies when booking; our kitchen handles wheat, dairy, eggs, nuts, and soy, and we can't guarantee an allergen-free environment. You take home what you make; we're not responsible for items left behind.
Photos. We sometimes photograph classes for our website and social media. Tell us at the class if you'd rather not be photographed.
7. Product information and allergens
We try to describe products accurately, but packaging, colors, and specifications can vary from photos. Ingredient and allergen information comes from the manufacturer; always check the product label before use, especially for allergies. Decorating supplies labeled non-edible must not be eaten.
8. Accounts
You're responsible for keeping your account password private and for activity under your account. Tell us promptly if you think your account has been used without permission.
9. Intellectual property
The site, its design, text, photos, and logos belong to Bake A Cake or our licensors and may not be copied or used commercially without permission. Product names and brand logos belong to their respective owners.
10. Acceptable use
Don't misuse the site: no attempts to break in, scrape, interfere with other customers, place fraudulent orders, or upload unlawful content.
11. Disclaimers and limitation of liability
Products are provided as described; to the extent allowed by law we disclaim implied warranties, including merchantability and fitness for a particular purpose, except where a manufacturer's warranty applies. To the extent allowed by law, our total liability for any order or class is limited to the amount you paid for it, and we are not liable for indirect or consequential losses (for example, a spoiled event or lost profits). Nothing here limits liability that can't be limited by law.
12. Governing law and disputes
These terms are governed by the laws of the State of Texas. If we have a dispute, please contact us first; most issues can be sorted out quickly. Any legal action will be brought in the state or federal courts located in Hidalgo County, Texas.
13. Changes
We may update these terms; the effective date shows the current version. Orders are governed by the terms in effect when they were placed.
